DOCTOR CONSENT AGREEMENT — DIALDOCTOR

Introduction
This Doctor Consent Agreement ("Consent Agreement") represents an express, legally binding declaration executed by you, an independent Registered Medical Practitioner or an authorized clinical administrator (hereinafter referred to as "Practitioner", "Doctor", "You", or "Your"), in favor of DialDoctor HealthTech (hereinafter referred to as "DialDoctor", "Firm", "Platform", "We", "Us", or "Our"), a partnership firm operating from Akola, Maharashtra.
IMPORTANT STATUTORY NOTICE: This document is electronically executed in compliance with Section 5 of the Information Technology Act, 2000 (recognition of electronic signatures) and Section 63 of the Bharatiya Sakshya Adhiniyam, 2023. Clicking "I Agree", checking the consent box, completing your profile registration, or executing an OTP verification constitutes a valid, legally enforceable digital signature equivalent to a wet-ink physical signature.
1. PROFESSIONAL DECLARATION & LICENSURE WARRANTY
By executing this Consent Agreement, you explicitly affirm, state, and declare under oath that:
- You are a Registered Medical Practitioner (RMP) in good standing, possessing valid, non-expired, and authentic academic degrees (e.g., MBBS, MD, MS, or recognized AYUSH equivalents) recognized by the National Medical Commission (NMC) Act, 2019 or respective state medical councils.
- The registration numbers, clinical certifications, and professional qualifications submitted by you during onboarding are true, accurate, and free from misrepresentation.
- You are fully authorized under local municipal ordinances and the Clinical Establishments Act, 2010 to list your brick-and-mortar facility and associate peer practitioners under your designated clinic umbrella on this Platform.
2. EXPRESS CONSENT FOR PROFILE CREATION, CURATION, AND PUBLIC DISPLAY
You hereby grant DialDoctor an explicit, non-exclusive, worldwide, royalty-free license to host, process, format, and publicly publish your professional corporate details on DialDoctor.in and its sister mobile applications. This permissible data scope includes:
- Your full professional name, academic suffixes, and field of medical specialization.
- Your state/national medical council registration number and total years of active clinical experience.
- Your physical clinic names, mapped geo-locations, real-time availability slots, and consultation fee matrices.
- Your professional portrait photographs and public patient-facing clinic descriptions.
You acknowledge that this information will be made searchable and indexable to the general public and prospective patients to facilitate discovery and appointment booking.
3. EXPLICIT AUTHORIZATION FOR CREDENTIALS VERIFICATION (KYC)
You grant an irrevocable authorization to DialDoctor and its compliance teams to perform periodic baseline verification audits of your academic and regulatory credentials. You consent to our checking your records against:
- The digital registries of the National Medical Commission (NMC) and State Medical Councils.
- Government-issued identification databases (e.g., Aadhaar, PAN, or clinic establishment licenses).
- Educational institution rolls to verify advanced fellowships or post-graduate designations.
You explicitly recognize that these verification checks are structured solely for platform internal safety and risk mitigation under the IT Intermediary Guidelines, 2021, and do not transfer any clinical liability or regulatory endorsement from you to DialDoctor.
4. CONSENT FOR SAAS-ENABLED APPOINTMENT FACILITATION
You consent to the integration of DialDoctor’s software-as-a-service (SaaS) workflow engine into your daily clinical practice. You agree that:
- Patients may digitally reserve physical or remote consult slots based entirely on the dynamic calendar parameters you actively populate on your clinic dashboard.
- The platform may issue digital appointment tokens, track check-in timestamps, and archive cancellation/rescheduling metrics generated during your platform tenure.
5. ABSOLUTE RECOGNITION OF INDEPENDENT MEDICAL AUTONOMY
You explicitly execute this declaration confirming that you understand and agree to the following structural boundaries of DialDoctor:
- Technology Intermediary: DialDoctor is strictly a software aggregator and never interferes with, guides, alters, or reviews your clinical diagnoses, treatment philosophies, or pharmaceutical prescriptions.
- Sole Responsibility: You remain uniquely and entirely liable for the quality of patient care, diagnostic accuracy, compliance with the Telemedicine Practice Guidelines, 2020, and the absolute retention of medical records as mandated by the National Medical Commission (NMC).
6. EXPRESS CONSENT FOR DIGITAL DATA PROCESSING & SYSTEM TELEMETRY
In compliance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, you grant your explicit consent to DialDoctor to collect, store, and process platform-specific analytical metrics. This includes:
- The deployment of automated diagnostic monitors such as Google Analytics 4, Mixpanel, and Microsoft Clarity to evaluate click-stream efficiency, eliminate layout bugs, and track performance latencies.
- The storage of secure session cookies on your clinic terminal to maintain logged-in statuses and protect administrative account tokens from cross-site scripting vulnerabilities.
7. OMNI-CHANNEL COMMUNICATION & DND OVERRIDE CONSENT
Pursuant to the regulations of the Telecom Regulatory Authority of India (TRAI), you hereby provide your express, explicit consent to receive automated transactional, regulatory, operational, and administrative alerts from DialDoctor. You authorize us to communicate via:
- Automated WhatsApp Enterprise Messaging Core.
- Short Message Service (SMS) Gateways.
- Direct Telephonic Voice Calls (facilitated via cloud telephony tools).
- Electronic Mail (Email) and in-app administrative push alerts.
DND Registry Waiver:This consent explicitly overrides any registration of your mobile number on central "Do Not Disturb" (DND) registers or the National Customer Preference Register (NCPR). These communications will contain vital appointment alerts, emergency practitioner re-schedulings, credential verification logs, and platform update notes.
8. LIMITATION OF LIABILITY AND NON-GUARANTEE OF VOLUMES
You acknowledge and affirm that DialDoctor makes no warranties, express or implied, regarding:
- The specific volume of patient footfall, digital visibility ratios, or click-through frequencies your profile will achieve.
- Guaranteed commercial revenue streams or minimum monthly consultation bookings.
- Uninterrupted 100% server uptime, given that the platform may occasionally undergo scheduled software security patches or encounter unexpected cloud provider disruptions.
9. FIRM’S DISCRETIONARY PLATFORM RIGHTS
You agree that DialDoctor retains the administrative right to:
- Temporarily unpublish or permanently delete profiles that contain unverified credentials, expired medical licenses, or misleading clinical specializations.
- Modify, augment, or transition the user interface, feature sets, and SaaS architecture tools at any point to optimize security and market efficiency.
10. COMPLETE ELECTRONIC EXECUTION AND ACCEPTANCE
By checking the box labeled "I Agree to the Doctor Consent Agreement", entering an authorized verification One-Time Password (OTP), or uploading your medical council credentials onto DialDoctor.in, you solemnly declare that:
- You have read, meticulously evaluated, and completely understood every clause of this Consent Agreement.
- You are providing this consent voluntarily, free from coercion, misrepresentation, or undue influence.
- This digital acceptance shall be afforded full legal status, validity, and enforceability under all competent judicial courts and consumer forums in the jurisdiction of Akola, Maharashtra, India.
