PATIENT TERMS & CONDITIONS — DIALDOCTOR

Introduction

These Patient Terms & Conditions constitute a legally binding electronic agreement between DialDoctor HealthTech, a partnership firm operating from Akola, Maharashtra, and the individual accessing the platform as a patient, healthcare seeker, or legal guardian.

By accessing, registering, booking appointments, or interacting with DialDoctor.in or our mobile applications, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not consent, please discontinue using the Platform immediately.

1. PLATFORM PURPOSE & INTERMEDIARY STATUS

DialDoctor operates strictly as an Intermediary under Section 2(1)(w) of the Information Technology Act, 2000 — a pure technology aggregator for digital discovery of Registered Medical Practitioners (RMPs) and digital appointment scheduling.

  • DialDoctor does not practice medicine, render clinical diagnoses, evaluate symptoms, dispense drugs, or offer healthcare advice.
  • The Platform is not a hospital, clinic, nursing home, laboratory, or diagnostic center.
  • Any appointment booked establishes an independent, bilateral professional relationship solely between the Patient and the designated RMP. DialDoctor is entirely insulated from the clinical lifecycle of your treatment.

2. EMERGENCY MEDICAL DISCLAIMER

THE PLATFORM IS NOT AN EMERGENCY RESPONSE OR RESCUE UTILITY.

DialDoctor does not provide critical care, trauma management, or emergency dispatch services. If you or the person you are booking for is experiencing:

  • Acute medical crisis or life-threatening symptoms
  • Severe chest pain or heavy bleeding
  • Psychological distress or accidental trauma

Immediately contact state emergency services: 102 or 108, or visit the nearest hospital Emergency Room (ER) or trauma center.

DialDoctor assumes zero legal liability for clinical delays or injuries caused by attempting to use this Platform during a medical emergency.

3. USER ELIGIBILITY & ACCOUNT RESPONSIBILITY

Age & Legal Competence

You must be at least 18 years of age to register an independent account. Minors are strictly prohibited from creating accounts independently and may only use the Platform under the direct supervision and explicit legal consent of a parent or court-appointed legal guardian.

Information Authenticity

You warrant that all personal data supplied during registration — including legal name, contact numbers, age, gender, and medical history — is authentic and current. Fabricating profiles, generating fake appointments, or impersonating another individual constitutes a material breach and may invite criminal prosecution under the Information Technology Act and the Bharatiya Nyaya Sanhita.

4. APPOINTMENT BOOKING & RMP DISCRETION

The scheduling of an appointment through DialDoctor is an automated facilitation service. You explicitly recognize that:

  • Real-time appointment validation relies entirely on calendar parameters updated by the independent RMP or their clinic staff.
  • Listed practitioners retain the right to cancel, delay, or reschedule slots due to surgical emergencies, medical duties, or institutional delays.
  • A booking confirmation never constitutes a guarantee of a specific medical outcome, clinical cure, or immediate treatment availability upon physical arrival at the clinic.

5. PROHIBITED PATIENT CONDUCT

Patients are strictly prohibited from:

  • Fraudulent Bookings: Generating fictional, repetitive, or bad-faith bookings to block an RMP's calendar slots or manipulate listing metrics
  • System Overuse & Spam: Using automated scripts, scrapers, or multiple devices to bypass booking limits or compromise backend APIs
  • Abusive Interaction: Directing defamatory, profane, threatening, or unparliamentary language against practitioners, clinic staff, or DialDoctor support executives
  • Malware Dissemination: Uploading corrupted files, infected diagnostic PDFs, or malicious data engineered to hijack the Platform's cloud storage

Violations will result in immediate termination of platform privileges and blacklisting of your device and IP.

6. FINANCIAL CONTROLS, FEES & E-COMMERCE COMPLIANCE

Fee Autonomy

Consultation prices and procedure fees are decided entirely by the independent RMP or their hospital establishment. DialDoctor does not arbitrate or manipulate practitioner pricing.

Consumer Protection Compliance

  • Upfront Pricing: All operational fees, service charges, or platform convenience fees will be explicitly displayed before final booking execution.
  • Refund & Cancellation: Governed by our standalone Cancellation and Refund Policy. DialDoctor holds no liability for cash-based financial transactions finalized directly within physical clinic premises.

7. DATA PRIVACY & CONSENT TO ELECTRONIC PROCESSING

Your personal and sensitive medical data is secured under our Privacy Policy. By using DialDoctor, you grant explicit consent under the IT (SPDI) Rules, 2011, for the Firm to:

  • Transmit your name, age, contact details, and self-reported symptoms to your selected RMP to prepare your clinical intake
  • Process anonymized tracking parameters through Google Analytics 4, Mixpanel, and Microsoft Clarity to evaluate platform performance
  • Send automated appointment updates, booking tokens, and platform alerts via SMS and WhatsApp enterprise gateways

8. LIMITATION OF LIABILITY & INDEMNITY

Total Liability Exclusion

To the maximum extent permitted under Indian law, DialDoctor shall never be held liable for:

  • Medical negligence, diagnostic errors, wrong prescriptions, or surgical malpractice by any listed RMP
  • Long waiting periods, sudden clinician no-shows, or administrative disputes at clinic premises
  • Psychological, physiological, or financial loss from information displayed on the Platform
  • Unexpected server outages, transaction drops, or platform maintenance windows

Patient Indemnity

The Patient agrees to indemnify and hold harmless DialDoctor from any financial claims, legal damages, or attorney fees arising from bad-faith platform use, rules violations, or malicious interactions with listed healthcare personnel.

9. INTELLECTUAL PROPERTY

The entire technological infrastructure of the Platform — including the brand name "DialDoctor", UI layouts, source code, booking engines, graphics, and database architectures — is the exclusive property of DialDoctor HealthTech, protected under the Copyright Act, 1957 and The Trademarks Act, 1999. Unauthorized duplication, reverse-engineering, or digital scraping will invite immediate civil and criminal action.

10. GOVERNING LAW & JURISDICTION

These Terms shall be governed and enforced in accordance with the laws of the Republic of India. Any legal dispute, consumer court filing, or formal litigation arising from Platform usage shall be filed under the exclusive jurisdiction of the competent courts in Akola, Maharashtra, India.

11. GRIEVANCE REDRESSAL

In compliance with the IT Intermediary Guidelines, 2021 and Consumer Protection (E-Commerce) Rules, 2020, DialDoctor has established a dedicated grievance mechanism:
